The Outlook for Online & Mobile Music Markets 

According to industry forecasts cited by Warner Music Group Chairman & CEO Edgar Bronfman in December, revenue from "digital" distribution (i.e., delivery via the Internet or other data network rather than via a physical medium such as CD) will increase from 2% industry-wide today to 25% to 27% in 2008. This represents a significant shift, due in part to positive consumer response to the iPod, ringtones, music phones, digital radio and other digital products now in the marketplace. This panel will discuss distribution platforms, devices and business models driving online and mobile music markets. How are record labels, music companies, telephone carriers and technology providers positioning their businesses to take advantage of opportunities in the digital music market?  How is the industry addressing obstacles - such as interoperability and pricing issues - to establishing a healthy and profitable marketplace?

The Clash Between Technology & Copyright Law
In December, the U.S. Supreme Court agreed to review the federal appellate court decision in MGM v. Grokster that held peer-to-peer software providers Grokster and StreamCast not liable for secondary or contributory copyright infringement. The case and others before it - e.g., Napster, Aimster and Betamax - have challenged the courts to determine how best to balance the competing interests of copyright protection and the promotion of technological innovation. This panel of legal and policy experts will discuss the main issues in MGM v. Grokster, including factors distinguishing it from the Napster, Aimster and Betamax decisions. What does this case mean for the future of peer-to-peer and online piracy? Who is winning the legal battle between copyrights and technology? Is legislative action likely in 2005?
